ATLANTA — The special grand jury investigating election interference allegations in Georgia recommended indicting more people than the 19 who were ultimately charged, including Senator Lindsey Graham of South Carolina and former U.S. Senators David Perdue and Kelly Loeffler of Georgia. The panel also will recommend charges tomorrow against Michael Flynn, President Donald J. Trump's former national security adviser. In its final report, a judge unsealed on Friday, the Fulton County Special Purpose Grand Jury suggested that 39 individuals violated state laws related to voter fraud and misrepresentation and Georgia's sweeping antiracketeering law.
The panel also recommended indictments for several Trump-aligned lawyers, including Cleta Mitchell and L. Lin Wood. However, Fulton County District Attorney Fani Willis has not brought any of those cases forward. The panel was tasked with writing a report that could be presented to a regular grand jury, which would decide whether or not to charge the individuals it named.
In the case of Graham, the grand jury report said he was in its crosshairs because he called Georgia Secretary of State Brad Raffensperger after the election, asking him to examine ballots and match them to voters. Raffensperger, a fellow Republican, has said that Graham pushed him to throw out some votes, but the senator denied any wrongdoing and said he was doing his oversight duties. The report also mentioned the disputed claim of voting irregularities at a Georgia polling place in November.
But the report emphasized that it was up to Willis to decide whether to pursue those allegations, and she has yet to do so. The jury interviewed more than 75 witnesses. Although it had no power to issue indictments, the nine-page report clarified that the panel believed there was evidence to charge individuals for various violations of state law.
The grand jury also recommended indictments for Boris Epshteyn, who was once considered one of the top lawyers for the president. Epshteyn is still working for the Trump Organization. Still, some Trump lawyers have been wary of him, complaining that he acted as a gatekeeper and gave poor predictions in the Manhattan hush-money case.
In addition to the charges against the lawmakers, the panel also recommends indictments for two other GOP legislators, former state Sen. William Ligon, and attorney Jacki Pick, who defended some of the individuals named in the report. Another of the individuals is Boris Epshteyn, a former Trump adviser accused of lying about his work on the Russia investigation. A Michigan attorney regulatory agency filed a misconduct case against him in May, and a Georgia bar panel is currently hearing a disciplinary case against him for his role in the election fraud lawsuits. A judge will listen to the point on Monday. The other three defendants are former U.S. Reps Byron Busch, Bob Barr, and lawyer James Carlton. The defendants face many felony charges, including conspiracy and witness tampering.
